Important Notice

☐ By placing my order, I confirm that I have read and agree to the Slinger Terms of Service, Return and Refund Policy, and Limited Warranty. I understand that the Slinger U-Flex is designed only for axle-back installation and is not designed to carry the full weight of an exhaust system by itself. I also agree to binding individual arbitration, waive my right to a court or jury trial, waive participation in class or representative actions, and acknowledge the applicable limitation of liability.

These Terms of Service contain a binding individual arbitration agreement, waiver of the right to a court or jury trial, class-action waiver, and limitation of liability.
Please read these Terms carefully before purchasing, installing, or using a Slinger U-Flex product.
1. Agreement to These Terms
These Terms of Service govern access to and use of [WEBSITE ADDRESS], including the purchase, installation, and use of the Slinger U-Flex Tailpipe Hanger and related Slinger products.
The website and Slinger products are operated and sold by Triple One LLC, operating under the Slinger brand.
In these Terms, “Triple One LLC,” “Slinger,” “we,” “us,” and “our” refer to Triple One LLC. “Customer,” “you,” and “your” refer to the purchaser, installer, vehicle owner, product user, or website user, as applicable.
By accessing the website, placing an order, selecting a checkbox indicating acceptance, purchasing a product, installing a product, or using a Slinger product, you agree to these Terms and the policies incorporated into them.
Do not purchase, install, or use a Slinger product unless you have read and agree to these Terms.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to place an order through the website.
By placing an order, you represent that:
•    The information you provide is accurate and complete.
•    You are authorized to use the selected payment method.
•    You are purchasing the product for a lawful purpose.
•    You have reviewed the product description, warnings, installation requirements, Return and Refund Policy, and Limited Warranty.
•    You understand that vehicle and exhaust configurations vary.
•    You accept responsibility for determining whether the product is suitable for the intended vehicle and installation.
•    You understand that the Slinger U-Flex is an auxiliary axle-back tailpipe support and is not designed to carry the full weight of an exhaust system by itself.
Important Product-Use Restrictions
3. Axle-Back Installation Only
The Slinger U-Flex is designed exclusively for axle-back installation.
For purposes of these Terms, “axle-back” means the rear-exhaust and tailpipe area located behind the vehicle’s rear axle.
The Slinger U-Flex must not be installed:
•    At or forward of the rear axle
•    In the mid-pipe area
•    Near or directly supporting a catalytic converter
•    Near or directly supporting an exhaust manifold or header
•    Near or directly supporting a front pipe or downpipe
•    In an area exposed to temperatures greater than those normally encountered in the intended rear axle-back tailpipe location
•    In any location where the product could interfere with suspension movement, steering, brakes, fuel lines, wiring, tires, driveshaft components, or other moving parts
Installation anywhere other than an appropriate axle-back location is outside the product’s intended use and may result in denial of warranty coverage.
Triple One LLC is not responsible for injury, exhaust damage, vehicle damage, property damage, or other loss resulting from installation outside the intended axle-back location.
4. Auxiliary Support Only
The Slinger U-Flex is an adjustable, supplemental axle-back tailpipe support.
The Slinger U-Flex is not designed, intended, tested, or rated to carry the full weight of an exhaust system by itself.
It must not be used as:
•    The exhaust system’s only hanger
•    The exhaust system’s only structural support
•    The primary support for an entire muffler or resonator
•    A replacement for all factory or aftermarket exhaust hangers
•    A repair for a cracked, broken, leaking, corroded, or structurally unsafe exhaust system
•    A substitute for repairing broken welds, brackets, pipes, clamps, rods, or isolators
•    A support for catalytic converters, headers, manifolds, front pipes, or other forward exhaust components
The exhaust system must remain independently and adequately supported by suitable factory or aftermarket exhaust hangers, brackets, isolators, rods, mounts, or other properly designed supports.
The Slinger U-Flex must not be installed where failure or removal of the Slinger U-Flex would allow the exhaust system to:
•    Fall
•    Separate
•    Drag on the roadway
•    Contact a tire or moving component
•    Contact the vehicle body or suspension
•    Create an unsafe operating condition
Any supplied safety cable is a secondary safety component. It is not a substitute for properly designed exhaust hangers or structural supports.
5. Products Covered
These Terms apply to the Slinger U-Flex Tailpipe Hanger and related Slinger products, including:
•    Sling straps
•    Axle-back mounting brackets
•    Pivot or flexible upper mounts
•    Heat-protection sleeves
•    Boost adjusters
•    Spacers
•    Fasteners
•    Safety cables
•    Replacement parts
•    Installation accessories
•    Product kits
Product photographs, demonstrations, illustrations, dimensions, fitment examples, and customer installations do not guarantee compatibility with every vehicle or exhaust system.
6. Exhaust-System Condition
Before installation, the customer or installer must inspect the vehicle and exhaust system and confirm that they are in safe operating condition.
Do not install the Slinger U-Flex on an exhaust system with:
•    Cracked or broken pipes
•    Failed welds
•    Severe corrosion
•    Missing hangers or structural supports
•    Broken brackets
•    Damaged isolators
•    Loose clamps
•    Exhaust leaks
•    Excessively heavy unsupported components
•    Unsafe alignment
•    Insufficient ground clearance
•    Contact with the body, suspension, drivetrain, fuel system, brake system, electrical system, tires, or other vehicle components
•    A condition that could cause the exhaust system to fall, separate, drag, or become unsafe
Installing the Slinger U-Flex does not repair or correct an underlying exhaust-system defect.
Existing defects must be corrected before the product is installed or the vehicle is operated.
7. Additional Exhaust Supports Required
The exhaust system must have sufficient independent structural support in addition to the Slinger U-Flex.
The customer and installer must ensure that:
•    The exhaust remains safely supported without relying solely on the Slinger U-Flex.
•    Factory or aftermarket hangers remain in usable condition.
•    Required hangers are not removed merely because the Slinger U-Flex is being installed.
•    Exhaust weight is properly distributed.
•    The Slinger U-Flex is not overloaded.
•    The product is not carrying the concentrated weight of an entire muffler, resonator, or exhaust assembly.
•    Removal or failure of the Slinger U-Flex would not permit the exhaust to fall or drag.
•    Any safety cable is installed correctly but is not treated as the primary support.
Triple One LLC does not determine the number, type, location, or load capacity of the other exhaust supports required for a particular vehicle.
8. Installation Responsibility
Installation must be performed by a person who understands:
•    Automotive exhaust systems
•    Axle-back exhaust mounting
•    Proper exhaust support
•    Vehicle-clearance requirements
•    Safe vehicle-lifting procedures
•    Proper fastener installation
•    Exhaust expansion
•    Suspension movement
•    Heat exposure
•    Ground-clearance requirements
Professional installation is strongly recommended whenever the customer is uncertain about installation, mounting, fitment, support, adjustment, clearance, or safety.
The customer and installer are responsible for:
•    Confirming that the product is installed only in an appropriate axle-back location
•    Selecting a structurally sound vehicle mounting point
•    Determining whether additional exhaust supports are needed
•    Maintaining the exhaust system’s existing structural support
•    Correctly positioning the Slinger U-Flex
•    Correctly installing all brackets, sleeves, spacers, fasteners, adjusters, and safety components
•    Tightening all hardware securely
•    Preventing over-tightening or component damage
•    Maintaining adequate exhaust-to-body clearance
•    Maintaining adequate suspension and drivetrain clearance
•    Maintaining safe ground clearance
•    Allowing for exhaust expansion and movement
•    Preventing contact with sharp edges
•    Preventing contact with hot, moving, or heat-sensitive components
•    Inspecting the completed installation before driving
Do not install the product in a manner that:
•    Places the full exhaust-system weight on the Slinger U-Flex
•    Uses the product as the only exhaust hanger
•    Pulls the exhaust out of alignment
•    Creates excessive stress on a pipe, weld, clamp, bracket, or mounting point
•    Restricts normal suspension movement
•    Creates inadequate ground clearance
•    Allows contact with another vehicle component
•    Creates a condition in which the failure of one component could allow the exhaust to fall
9. Incorrect, Unsafe, or Inadvisable Installation
Not every installation that is physically possible is safe, correct, or advisable.
An installation is considered incorrect, unsafe, unsuitable, or inadvisable when it:
•    Is located anywhere other than the intended axle-back area
•    Uses the Slinger U-Flex as the exhaust system’s only support
•    Places excessive weight, tension, or heat on the product
•    Removes necessary factory or aftermarket hangers
•    Attaches to a weak, damaged, or inappropriate vehicle component
•    Creates inadequate ground clearance
•    Creates inadequate clearance from the body, suspension, drivetrain, tires, wiring, brakes, or fuel system
•    Causes the exhaust to bind during thermal expansion
•    Causes interference during suspension movement
•    Allows contact with sharp edges
•    Uses damaged, substituted, or incorrectly sized hardware
•    Omits a required safety component
•    Attempts to support a defective exhaust system
•    Creates a foreseeable risk of injury, exhaust failure, or vehicle damage
Triple One LLC is not responsible for determining whether a customer-designed installation is appropriate unless Triple One LLC expressly approves that exact installation in a written document signed by an authorized Triple One LLC representative.
General instructions, photographs, videos, diagrams, customer-service communications, and product demonstrations do not constitute engineering approval or certification of a particular installation.
10. Exhaust-System Failures
To the fullest extent permitted by law, Triple One LLC is not responsible for the failure of an exhaust system or vehicle component that is not caused by a proven manufacturing defect in the Slinger product itself.
This includes failures involving:
•    Exhaust pipes
•    Welds
•    Clamps
•    Mufflers
•    Resonators
•    Catalytic converters
•    Factory or aftermarket hangers
•    Rubber isolators
•    Mounting rods
•    Vehicle brackets
•    Exhaust tips
•    Flanges
•    Gaskets
•    Flex joints
•    Other exhaust or vehicle components
Triple One LLC is not responsible for exhaust-system failure or damage caused by or related to:
•    A preexisting defect
•    Corrosion
•    Metal fatigue
•    Failed welds
•    Loose or improperly installed clamps
•    Excessive exhaust weight
•    Missing supports
•    Improper weight distribution
•    Road impact
•    Collision
•    Excessive heat
•    Engine or drivetrain movement
•    Incorrect installation
•    Installation outside the axle-back area
•    An unsafe, unsuitable, or inadvisable installation
•    Failure to inspect or maintain the installation
•    Use of the Slinger U-Flex as the sole exhaust support
•    Continued operation after a problem became visible or reasonably apparent
The presence of a Slinger U-Flex on a vehicle does not establish that the product caused an exhaust-system failure.
11. Vehicle-Lifting Safety
Never work beneath a vehicle supported only by a jack.
Use properly rated jack stands, ramps, lifts, wheel chocks, protective equipment, and appropriate tools. Follow the vehicle manufacturer’s lifting and service procedures.
Allow the exhaust system to cool before installation, adjustment, inspection, or removal.
Triple One LLC is not responsible for injury or property damage caused by unsafe vehicle lifting, inadequate support equipment, hot components, improper tools, or unsafe work practices.
12. Required Inspection
The completed installation must be inspected before the vehicle is driven.
The inspection must confirm that:
•    The product is located only in the axle-back area.
•    The exhaust has adequate independent support.
•    The Slinger U-Flex is not carrying the full exhaust-system weight.
•    All hardware is correctly installed and tightened.
•    Brackets and mounting points are secure.
•    The sling is positioned correctly.
•    Heat-protection components are installed correctly.
•    The safety cable is installed when included or required.
•    The exhaust is properly aligned.
•    The exhaust does not contact the body, frame, suspension, drivetrain, fuel system, brake system, wiring, or tires.
•    Safe ground clearance is maintained.
•    Suspension movement will not cause contact.
•    Exhaust expansion will not cause binding or excessive tension.
•    No component is damaged, torn, melted, cut, excessively bent, or overloaded.
The installation must also be inspected:
•    After the first drive
•    After approximately 50 to 100 miles
•    Periodically during normal maintenance
•    After exhaust or suspension service
•    After road impact or contact with an obstruction
•    Whenever exhaust position, movement, noise, or clearance changes
Stop operating the vehicle if the product or exhaust becomes loose, damaged, overloaded, heat-damaged, incorrectly positioned, or unsafe.
13. Product Information
Triple One LLC makes reasonable efforts to provide accurate descriptions, measurements, photographs, illustrations, instructions, prices, and availability information.
However:
•    Photographs may show prototypes, optional components, or demonstration installations.
•    Vehicles, tools, and exhaust systems shown are not included unless expressly stated.
•    Product appearance, texture, finish, hardware, packaging, and configuration may vary.
•    Hardware or packaging may be updated without materially changing the product’s function.
•    Installation illustrations may be simplified.
•    Website information may contain typographical, pricing, measurement, or availability errors.
Triple One LLC may correct errors and update information at any time.
14. Orders and Payment
Submitting an order is an offer to purchase the products listed in the order.
An automated confirmation acknowledges receipt but does not necessarily mean the order has been accepted or shipped.
Triple One LLC may refuse, limit, hold, or cancel an order because of:
•    Product unavailability
•    Incorrect pricing or product information
•    Suspected fraud
•    Unauthorized payment
•    Shipping restrictions
•    Incomplete or unverifiable information
•    Suspected misuse
•    Unauthorized resale
•    Violation of these Terms
•    Events outside our reasonable control
If an order is canceled after payment has been processed, the canceled amount will be refunded to the original payment method.
Prices are displayed in United States dollars unless otherwise stated. The final charge may include product price, shipping, handling, applicable taxes, and other charges disclosed before checkout.
15. Shipping and Delivery
Shipping and delivery dates are estimates unless Triple One LLC expressly guarantees a date in writing.
The customer is responsible for providing a complete and accurate shipping address.
Carrier tracking records may be used as evidence of shipment and delivery.
Inspect the package promptly. Retain the product, packaging, shipping label, and packing materials when reporting damage, shortages, or an incorrect order.
16. Damaged, Missing, or Incorrect Orders
Contact Slinger Customer Support within seven calendar days after delivery if:
•    The package arrived damaged.
•    A component is missing.
•    The wrong product was received.
•    A component appears damaged or defective before installation.
Provide the order number, photographs of the package and shipping label, photographs of the product, and a written description of the issue.
Do not discard packaging or damaged components until instructions are provided.
17. Returns and Refunds
Returns, exchanges, and refunds are governed by the separate Slinger Return and Refund Policy, which is incorporated into these Terms.
Unless that policy states otherwise:
•    Return requests must be submitted within 30 calendar days after delivery.
•    Return authorization is required.
•    The product may be carefully assembled and test-fitted.
•    The vehicle must not have been driven with the product installed.
•    The product must not have been exposed to exhaust heat.
•    The product must be clean, complete, and resalable.
•    Road-used, heat-exposed, modified, cut, drilled, welded, damaged, or incomplete products may not qualify.
•    The customer pays return shipping for preference, fitment, ordering-error, or change-of-mind returns.
•    Triple One LLC covers reasonable return shipping when it sent the wrong product or confirms a manufacturing defect or shipping damage.
•    Original shipping and handling charges are not refundable unless the return resulted from our error or a confirmed defect.
18. Limited Warranty
Any warranty applicable to a Slinger product is governed by the separate written Slinger Limited Warranty provided with the product or posted on the website.
The Limited Warranty covers only the purchasers, products, conditions, time periods, and remedies identified in that warranty.
No product description, advertisement, photograph, video, customer-service conversation, social-media post, review, installer statement, or reseller statement modifies the written warranty unless Triple One LLC approves the modification in a written document signed by an authorized representative.
19. Warranty Claim Requirements
A warranty claim must include:
•    Customer’s full name
•    Order number or proof of purchase
•    Purchase date
•    Vehicle year, make, and model
•    Description of the exhaust system
•    Description of the axle-back installation location
•    Date of installation
•    Approximate mileage since installation
•    Written explanation of the issue
•    Photographs of the claimed issue
•    Photographs showing the complete installation
•    Any measurements, videos, or information reasonably requested by Triple One LLC
The customer must retain the product, hardware, and affected components until the claim is resolved or Triple One LLC confirms in writing that the items may be discarded.
Triple One LLC may require the product to be returned for inspection.
20. Required Installation Photographs
Installation photographs must be submitted with any:
•    Warranty claim
•    Product-defect report
•    Fitment complaint
•    Damage report
•    Product-performance complaint
•    Claim involving exhaust or vehicle damage
The photographs must clearly show:
•    That the product was installed behind the rear axle
•    The complete Slinger U-Flex installation
•    The upper mounting point
•    The vehicle mounting location
•    The mounting bracket
•    The sling’s position around the tailpipe
•    All bolts, nuts, washers, spacers, and adjusters
•    Heat-protection sleeves
•    Boost adjusters
•    The safety cable
•    Existing factory or aftermarket exhaust hangers
•    Other structural exhaust supports
•    Exhaust-to-body clearance
•    Suspension and drivetrain clearance
•    Ground clearance
•    Nearby vehicle components
•    The damaged or disputed area
•    Any melting, tearing, wear, bending, loosening, corrosion, overloading, or road contact
Close-up photographs of only a removed component are not a substitute for complete installation photographs.
Whenever reasonably and safely possible, photographs must be taken before the product is removed, repositioned, adjusted, repaired, modified, replaced, or discarded.
21. Failure to Provide Installation Photographs
Triple One LLC reserves the right to delay or deny a warranty claim when:
•    Installation photographs are not provided.
•    The photographs do not establish that the product was installed in the axle-back area.
•    The photographs do not adequately show the complete installation.
•    Other exhaust supports are not visible.
•    Mounting points or safety components are not visible.
•    The product was removed, modified, repaired, replaced, or discarded before documentation.
•    Requested measurements, photographs, videos, or information are not provided.
•    Missing documentation prevents Triple One LLC from determining whether the product was overloaded or improperly installed.
•    Missing documentation prevents Triple One LLC from reasonably determining the cause of the issue.
Triple One LLC may consider alternative evidence when photographs could not reasonably or safely be obtained.
Nothing in this provision eliminates a consumer right that cannot legally be excluded.
22. Warranty Exclusions
Warranty coverage may be denied for damage or failure caused by:
•    Installation anywhere other than an axle-back location
•    Using the Slinger U-Flex to carry the full exhaust-system weight
•    Using it as the only exhaust hanger
•    Missing, damaged, or inadequate additional supports
•    Excessive loading
•    Improper or incomplete installation
•    Incorrect positioning
•    An unsafe, unsuitable, or inadvisable installation
•    Failure to follow instructions
•    Failure to install required safety components
•    Loose or incorrectly tightened hardware
•    Failure to inspect or maintain the installation
•    Inadequate clearance or near excessive high heat components
•    Contact with sharp or moving components
•    Road contact or debris
•    Collision or impact
•    Normal wear
•    Exhaust leaks
•    Excessive heat
•    Chemical contamination
•    Environmental corrosion
•    Racing, competition, or track use
•    Off-road use
•    Vehicle abuse
•    Installation on a damaged or unsafe exhaust system
•    Cutting, drilling, welding, bending, or modifying the product
•    Incorrect or substituted hardware
•    Failure of another exhaust or vehicle component
•    Continued use after a problem became apparent
23. Assumption of Automotive Risks
Automotive work, exhaust-system work, vehicle modification, vehicle lifting, and working beneath a vehicle involve inherent risks, including burns, cuts, falling components, vehicle movement, exhaust leakage, road contact, reduced clearance, property damage, personal injury, and death.
Customers and installers must use appropriate tools, lifting equipment, protective equipment, and safe procedures.
Nothing in these Terms releases Triple One LLC from liability that cannot legally be waived.
Dispute Resolution, Arbitration, and Liability Limits
24. Informal Dispute Resolution
Before beginning arbitration or a court proceeding permitted under these Terms, the customer and Triple One LLC must first attempt to resolve the dispute informally.
The party making a claim must send a written Notice of Dispute containing:
•    The claimant’s name and contact information
•    Order number
•    Description of the product
•    Description of the dispute
•    Supporting photographs and documents
•    The specific resolution requested
Notices to Triple One LLC must be sent to:

The parties will have 30 days after receipt of the Notice of Dispute to attempt an informal resolution.
This informal process is a required step before arbitration, except when immediate temporary relief is reasonably necessary to prevent destruction of evidence or immediate irreparable harm.
25. Binding Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for matters eligible for small-claims court and claims that applicable law does not permit to be arbitrated, any dispute, controversy, or claim arising out of or relating to:
•    The website
•    An order
•    A Slinger product
•    Product advertising
•    Product installation
•    Product performance
•    An alleged defect
•    Warranty coverage
•    An exhaust-system failure
•    Vehicle or property damage
•    These Terms
•    The interpretation or alleged breach of these Terms
will be resolved by final and binding individual arbitration, rather than by a lawsuit in court.
The arbitration will be administered by the American Arbitration Association, or “AAA,” under the AAA Consumer Arbitration Rules in effect when the arbitration is filed, as modified by these Terms.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
The arbitration may be conducted by documents, telephone, video conference, or an in-person hearing, as permitted by the applicable AAA rules and determined by the arbitrator.
When an in-person consumer hearing is required, it will occur at a reasonably convenient location for the customer unless the parties agree otherwise.
Triple One LLC will pay arbitration fees that the applicable AAA Consumer Arbitration Rules require the business to pay. The customer will pay no more than the amount the applicable consumer rules assign to the customer, unless the arbitrator determines that a claim was filed for an improper purpose or applicable law permits a different allocation.
The arbitrator may award only the individual remedies available under these Terms and applicable law.
Judgment on the arbitration award may be entered in any court having jurisdiction.
26. Waiver of Court and Jury Trial
BY ACCEPTING THESE TERMS, BOTH THE CUSTOMER AND TRIPLE ONE LLC KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO HAVE A COVERED DISPUTE DECIDED BY A JUDGE OR JURY IN COURT.
Arbitration does not involve a judge or jury. Arbitration procedures may be more limited than court procedures, and review of an arbitration award by a court is limited.
This waiver does not prevent either party from bringing an individual claim in an eligible small-claims court or exercising a right that cannot legally be waived.
27. Individual Claims Only and Class-Action Waiver
ALL ARBITRATION AND PERMITTED COURT CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS.
To the fullest extent permitted by law, neither the customer nor Triple One LLC may:
•    Bring or participate in a class action
•    Bring a private-attorney-general action in a representative capacity
•    Act as a class representative
•    Join or consolidate claims belonging to different customers
•    Seek relief on behalf of another customer or the general public
•    Participate in class, collective, consolidated, coordinated, or representative arbitration
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim.
If a court determines that applicable law prohibits enforcement of this class or representative-action waiver for a specific claim or requested remedy, that claim or remedy will proceed in court only after all arbitrable claims have been completed, unless applicable law requires otherwise.
28. Small-Claims Court Exception
Either party may bring an individual claim in a small-claims court with jurisdiction if the claim remains within that court’s limits and is pursued only on an individual basis.
If a small-claims case is transferred, removed, or appealed to a court of general jurisdiction, either party may require the dispute to be resolved through arbitration.
29. Maximum Recovery and Limitation of Liability
To the fullest extent permitted by applicable law, the total aggregate amount that may be awarded or recovered from Triple One LLC for any claim arising from or related to a Slinger product, transaction, installation, warranty, or these Terms will not exceed:
Two times the purchase price actually paid to Triple One LLC for the specific Slinger product giving rise to the claim.
For example, if the customer paid $100 for the specific product giving rise to the claim, the maximum aggregate recovery would be $200.
This maximum applies collectively to all forms of monetary recovery arising from the same product or occurrence, including direct damages, statutory damages, penalties, fees, costs, and any arbitration or court award, except to the extent applicable law prohibits including a particular remedy within the limitation.
To the fullest extent permitted by law, Triple One LLC will not be liable for:
•    Indirect damages
•    Incidental damages
•    Special damages
•    Exemplary damages
•    Punitive damages
•    Consequential damages
•    Loss of vehicle use
•    Vehicle downtime
•    Towing expense
•    Substitute transportation
•    Lost income
•    Lost profits
•    Lost business opportunity
•    Damage caused by a falling or dragging exhaust system
•    Damage caused by another failed exhaust or vehicle component
The two-times-purchase-price limitation does not apply to liability or remedies that applicable law does not permit Triple One LLC to limit or exclude.
Nothing in these Terms excludes liability for fraud, intentional misconduct, or another liability that cannot legally be excluded.
30. Severability of Arbitration Provisions
If a portion of the arbitration agreement is found invalid or unenforceable, that portion will be severed to the minimum extent necessary and the remaining arbitration provisions will continue in effect.
However, if the prohibition against class, collective, consolidated, coordinated, or representative arbitration is found unenforceable for a particular claim, that claim will not proceed in class or representative arbitration. It will proceed in court to the extent required by law.
31. Website Use
The website may be used only for lawful shopping, product-information, customer-service, and related purposes.
You may not interfere with website security, attempt unauthorized access, introduce malicious code, submit false payment information, commit payment fraud, impersonate another person, scrape protected content without authorization, or use the website in violation of law.
32. Intellectual Property
The website and its product names, designs, photographs, diagrams, graphics, labels, logos, instructions, packaging, videos, and written materials are owned by or licensed to Triple One LLC.
Purchasing a product does not transfer ownership of Triple One LLC intellectual property.
“Slinger,” “Slinger U-Flex,” associated product names, logos, packaging, and trade dress may be trademarks or claimed trademarks of Triple One LLC.
33. Reviews and Submitted Content
By voluntarily submitting content for publication or promotional use, you grant Triple One LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, resize, edit for clarity, publish, display, distribute, and promote that content.
Photographs submitted privately for a warranty claim do not, by themselves, authorize public advertising use. Separate permission will be requested before identifiable claim photographs are used publicly.
34. Privacy and Third-Party Services
Collection and use of personal information are governed by the separate Slinger Privacy Policy.
The website may use third-party payment processors, carriers, hosting providers, analytics services, social-media services, installers, and suppliers. Those services may be governed by separate terms and privacy policies.
35. Governing Law
Except to the extent governed by the Federal Arbitration Act or a non-waivable law of another jurisdiction, these Terms are governed by Indiana law, without regard to conflict-of-law principles.
Any court proceeding permitted under these Terms must be brought in a court having jurisdiction in or serving St. Joseph County, Indiana, unless applicable law permits or requires the customer to proceed elsewhere.
36. Changes to These Terms
Triple One LLC may update these Terms to reflect changes in its products, business practices, website, services, or legal obligations.
The revised Terms will be posted with an updated “Last Updated” date.
Changes will apply prospectively and will not retroactively change the material terms governing a completed order unless required by law or agreed to by both parties.
37. Severability
If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed to the minimum extent necessary.
The remaining provisions will continue in effect.
38. No Waiver
A delay or failure by Triple One LLC to enforce a provision does not waive the right to enforce it later.
39. Entire Agreement
These Terms and the policies incorporated into them constitute the agreement between the customer and Triple One LLC concerning website use and product purchases.
